أصدره مجلس إدارة الهيئة العامة للعقار بالمملكة العربية السعودية ضوابط الإعلانات العقارية من أجل تعزيز الثقة في سوق العقارات ومواجهة الإعلانات الوهمية التي تهدد مصداقية المنصة الخاصة بالإعلانات مما يؤثر بشكل كبير على سوق العقارات ويعرض المواطنين للنصب. وقد شملت ضوابط الإعلانات العقارية في السوق السعودي ما يلي:

  • أن يكون الشخص المعلن يحمل الجنسية السعودية.
  • أن يكون المعلن مسجل من خلال منصة النفاذ الوطني.
  • أن يكون الشخص المعلن هو مالك العقار، أو لدية وكالة شرعية من مالك العقار، كما يمكن أن يكون وسيط عقاري بتفويض مكتوب او من خلال أمر قضائي.
  • ذكر اسم المعلن في الإعلان وصفته أو أي شخصية اعتبارية لديها رخصة لمزاولة النشاط في السعودية.

مخالفات ضوابط السوق العقاري

حددت الهيئة العامة للعقار عقوبة مخالفة أحد شروط الإعلان والترخيص للمنصات العقارية الإلكترونية والتي تتمثل فيما يلي:

  • يتم إلزام المنصة بحذف الإعلان بجانب الإنذار للمخالفة.
  • يمكن أن يتم إيقاف المعلن من نشر الإعلانات عبر المنصة لمدة لا تتجاوز العام.
  • يمكن أن يتم تعليق ترخيص المنصة العقارية لفترة معينة مع الإعلان عن هذا الإجراء.
  • يمكن أن يصل الأمر إلى سحب الترخيص من المنصة الإلكترونية ويتم الإعلان عن هذا القرار بشكل رسمي.
  • كل هذا بالإضافة إلى إحالة المخالفين إلى الجهات المختصة من أجل استكمال الإجراءات النظامية بخصوصهم.
