زواج السعودي بغير السعودية

تتعدد الخلافات الأسرية الناشئة بسبب زواج السعودي بغير السعودية وتتعدد أسبابها. فمنها بسبب عدم التزام الزوج بقيد الزوجة بصورة نظامية، ومنها بسبب عدم موافقة الزوجة السعودية على زواج زوجها السعودي بغير سعودية، وغيرها من الأسباب .

نظرا لرغبة الكثير من المواطنين السعوديين الزواج بغير السعودية، فقد أجاز المشرع السعودي ذلك بشروط ووفق أحوال معينة ومنها على سبيل المثال ما يلي:

  1. يجب أن يكون سن الراغب بالزواج يتراوح ما بين (30) و (70) عاماً، ويستثنى من ذلك من سبق له الزواج بزوجة سعودية.
  2. إذا كان الراغب بالزواج متزوج بالفعل ويريد الزواج من غير سعودية، فعليه تقديم تقرير طبي من مستشفى حكومي يثبت أن زوجته الأولى تعاني من حالة طبية تمنعها من الإنجاب.
  3. إذا كان الراغب في الزواج سبق له الزواج بسعودية ثم طلقها، فعليه ان يثبت حالة الطلاق.

إذا كان يعاني من مرض معين يمنعه من الزواج بسعودية، مثل أن يكون مصاب بإضرابات نفسية كالاكتئاب ونحوه فعليه اثبات ذلك بتقرير طبي معتمد

إن قيام بعض الراغبين بالزواج بغير السعودية على مخالفة الأنظمة المعنية في حال عدم انطباق الشروط عليه، يتسبب بكثير من الخلافات الأسرية،

ومنها استقدام الزوجة برخصة عمل منزلية أو على غير كفالة الزوج، وغيرها من طرق التحايل على نظام الإقامة.

فتنشأ بذلك خلافات أسرية بين الزوج وزوجته وجميعها تعالج خارج الأطر النظامية.

وقد يلجأ الزوج الى تسجيل أبناءه بشهادات ميلاد غير صحيحة، ومنها تبديل اسم الأم الى اسم زوجته السعودية، أو اهمال تسجيل الأبناء مطلقاً، مما يحرم الأبناء والزوجة حقوقهم الشرعية والنظامية كالتعليم والصحة وغيرها من الخدمات الأساسية.

ومن الخلافات الأسرية التي تنشأ بسبب زواج السعودي بغير السعودية بصورة غير نظامية، هي الخلافات التي تنشأ بينه وبين زوجته السعودية وما يسببه لها من ضغط نفسي واجتماعي. فعندما لا تكون الزوجة السعودية موافقة على زواجه بغير السعودية ولجؤه الى التحايل على النظام وهي تعلم بذلك جيداً، فإنها تنشأ كثير من الخلافات الأسرية بسبب تصرفات الزوج للتحايل على النظام وقد يستخدم اسمها في كثير من الأحوال بصورة غير جائزة.

وتمتلئ جنبات محاكم الأحوال الشخصية بكثير من هذه الحالات والخلافات الأسرية سواء بين الزوجين أو بسبب اثبات نسب الأبناء، ومعالجة هذه الأخطاء قد يؤدي إلى معاقبة المخالف أو تشتيت الأبناء، وهي من القضايا المعقدة التي تحتاج الى حكمة وروية وتبصير بعواقب الإقدام على مخالفة أحكام الأسرة والزوجية.
