في إطار جهود الدولة في مكافحة الغش التجاري ، والحد من انتشار جرائم الغش والتقليد في المعاملات التجارية، فقد لاحظت الدولة حفظها الله ازدياد عمليات الغش التجاري وتقليد السلع ، مما ألحق ضرر بالغ بالمستهلك وأنتج آثار سلبية سواء اقتصادية أو صحية أو اجتماعية.
الأمر الذي استدعى المشرع للتدخل وتعديل المادة (23) من نظام مكافحة الغش التجاري الصادر بتاريخ 23/04/1429ه، وذلك للحد من الظواهر السلبية الناجمة عن مخالفة أحكام النظام.
وصدر المرسوم الملكي رقم (م/109) وتاريخ 26/12/1442ه بتعديل حالات إبعاد الأجنبي المخالف لأحكام نظام مكافحة الغش التجاري ، وفي حال قيام الأجنبي بارتكاب جريمة الغش التجاري فإن النيابة العامة توجه تهمة الغش التجاري له بعد التحقيق معه ، ولها أن تطلب منعه من السفر وإحالته الى المحكمة الجزائية فيصدر بحقه حكم نهائي بالإدانة أو بعدمها وفق نظام الإجراءات الجزائية. وعند صدور حكم نهائي بإدانته بالجريمة، تقوم وزارة الداخلية بإبعاده عن المملكة ومنعه من دخولها ، وذلك وفقاً لضوابط تضعها وزارة الداخلية ووزارة التجارة ووزارة الاستثمار .
وحيث أن مسؤولية مكافحة ظاهرة الغش التجاري لا تنحصر على الجهات المختصة بالدولة فقط ، وإنما هي مسؤولية على كل فئات المجتمع، وتبدأ هذه المسؤولية من الفرد ودوره في أسرته.
ونرى انه مهما كان النظام واضحاً بشأن تطبيق العقوبات وتتبع المخالفين، فإنه يجب تكثيف الحملات التوعوية لتصل إلى جميع أفراد المجتمع ، وشرح مدى خـطورة هذه الظاهرة على الأجيال القادمة ، وأضـرارها الاقتصادية والاجتماعية ، ولا تتحقق أهداف مكافحة الغش التجاري إلا بوجود ثقافة اجتماعية مقاومة له.
وفي الختام ، يمكن القول إن الدولة لن تتهاون في المساس بحقوق المستهلك ، أو تطبيق العقوبات الرادعة أو تشديدها فيما بعد ، وهو ما أدى إلى تعديل النظام حالياً ليتناسب مع منع هذه الظاهرة.
ومع سهولة تقديم البلاغ بسبب التقدم وتطور التقنيات والتطبيقات ، فقد أصبح الأمر يسيراً ليشارك المجتمع الدولة في جهودها لحماية الجميع من هذه الظاهرة.
